Below is the situational analysis:
Procurement promotes economic growth and strengthens the economy by boosting the local capacity for commerce. Corruption stifles economic growth and depreciates the level of trust in both the process and those entrusted to acquire good and services. Transparency is the key factor that will lead to excellence in the procurement because it mitigates conditions that are the basis for corruption. Transparency in government procurement and acquisitions is a challenge but not impossible.
Often corruption is the direct result of the lack of knowledge and training, as well as the other issues such as poor decisions, inadequate oversight, and ill intent for personal gain. Both government and contractors have their own motivations for the lack of transparency; however, increasing transparency benefits the government, taxpayers, and contractors. In order to have transparency in the procurement field training and education must be considered as paramount next to oversight and accountability. With oversight, we confirm that processes and procedures are followed and we use accountability to ensure those entrusted with the procurement process have the requisite credentials. Therefore, we must ask what the qualification is, how do we verify this; and, what elements are in place to deter fraud and corruption? We must understand the cause and effect in order to alleviate the problem.
Agencies that ensure acquisition and procurement professionals have the education and/or training tend to have fewer problems because the employees know how to deal with complex issues without unwittingly committing fraud. They understand the legal issues associated with procurement. Therefore, we assume that employees who understand the procurement language and processes, rules of the Federal Acquisition Regulation (FAR) are less likely to commit fraud and participate in practices that prime corruption.
Corruption can begin with inadequate defined requirements. Therefore, it is important to invest the time and resources required to properly describe the good or service needed. Requirements that are not clearly defined open the door for corruption, fraud, and poor business practices. An example of such would be conducting a procurement or acquisition with an inadequately defined requirement that results in a price increase for something that should have been included in the original contract. In other words, the contractor profits by making modifications that he or she knew were intentionally or ignorantly omitted. The reason for the omission may be based on several factors; a rush to obligate the funds, collusion with the contractor, or simply the lack of training. Adequate training and experience are mitigating factors for poor business practices; thus, agencies must require education and training to decrease the conditions that lead to corruption. Personnel in the procurement field must be well trained and educated agency procedure and how the procedures align with regulatory requirement. Management must routinely communicate and evaluate performance to ensure personnel thoroughly understand the procurement process and the legal consequences of deviating from policy.
