I need points and authorities on the authority of the personal representative to pay a lien on a beneficiaries portion of the estate after the Final Order of Distribution Hearing. THIS IS CALIFORNIA LAW. The hearing was on 4-12-18. The court ordered the distribution of the estate to the two beneficiaries. The attorney for the Personal Representative submitted an Order and it was rejected by the court for excessive attorney fees. A creditor to the beneficiary had a lien on the beneficiary's interest and filed his lien on 7-18-18. The creditor did not properly provide notice of its claim at any time during the case. The Final Order of Distribution was signed and filed by the Court on 9-12-18. It did not give the personal representative authority to pay anyone other than the attorney, the personal representative and the two beneficiaries. I have attached Exhibits. I need points and authorities addressing: 1. The lien against the beneficiaries share of the estate was not properly noticed (there is a procedure for that); it was untimely; no late application of claim was made (is the lien considered a claim?) - Probate Code 9103; the court did not authorize payment 2. Personal Representative improperly paid the lien - failed to follow the court order for Final Order for Distribution.
