Background
During the urgent public health concerns, COVID-19, the face mask became high demand that lead to shortages. We began to sell face mask on Amazon from early March to middle April. In order to sell face masks on Amazon, we have applied and get approved to the Sanitary Face Masks category. We got thousands sales on Amazon since face masks are are currently in great demand, then Amazon held our funds due to Velocity Limits and Account Reviews: [login to view URL], all orders have been dispatched in time and most orders have been delivered so far. But Amazon deactivated our account finally, and noticed us “we may permanently withhold any payments to you”, please refer the full notification from Amazon on attachment. It may triggered by Amazon update their sales threshold since we found they update their requirement to selling face masks after that, but there is no any email of font desk notification. We have nearly 160,000 USD in our selling account.
We got a death blow in this case, we have spent all our saving to fulfill orders to Amazon customers, but Amazon is robbing sellers. We believe it is immoral and illegal, so we may need specialist in different domains help us to defend our rights.
Legal Research: Face Masks Compliant Requirements
According to Amazon notification, the reason of our selling account deactivated is “You have deceptively listed N95 or similar masks in our consumer store. This product type is currently restricted from sale on Amazon.com. Items sold on [login to view URL] must adhere to all applicable laws and Amazon’s policies”.
Therefore, we need to do full legal research on face masks compliant requirement in US, including:
Is there any certification, third-party test report, or any other documents are required for selling general disposable face masks, surgical masks(for health care professionals), N95 Respirators(may published by FDA, CDC, HIOSH, OASH, other authorities or laws)?
The masks we sold have have certification and third-party test report under Chinese government supervision, as I know, CDC has recognize part of Chinese mask standards, such as use KN95(GB 2626-2006\GB 2626-2019) as alternatives of N95(NIOSH-Certified).
Since polices may have several changes during the March 1st to April 15th, so we may need all compliant requirements during the period, to make sure we didn’t break the law.

Since Amazon may has multiple performance teams, we may need to submit our appeal to the most efficient Amazon department to reinstated our selling account or release our funds at least.
Therefore, you should have rich experience of submitting appeals to Amazon and reinstating selling accounts successfully.
You may need to work with our other legal counsels and ensure that we will not leave any adverse evidence to Amazon during the appeal process.
We may not submit appeal letter, but you may provide the efficient Amazon performance team’s contact information to our legal counsels, so what we can submit our legal demand letter to them as our appeal.

If still no works, you may use any method including but not limit such as file arbitration against Amazon, suit against Amazon to court, to force Amazon release our funds back.
